REC Tenders for Legal Counsel on Adani's 150 MW Rajasthan Plant

The Rural Electrification Corporation Limited (REC) has issued a new tender for the engagement of Lender’s Legal Counsel, with detailed specifications available in Annexure A.

The scope of work is indicative and may be subject to change, with the entire assignment expected to be completed within two months from the date of the letter of award. While extensions may be granted at REC’s discretion, no additional fees will be provided. Bidders are required to submit their quotations on a lump-sum basis, covering all professional fees, charges, and expenses, excluding GST. This includes costs associated with site visits, verification of permissions, and obtaining certified copies.

The financial bid must be submitted online through REC’s e-procurement portal. Only the total bid price excluding GST will be considered for evaluation. Participants must provide the names and professional profiles of their team members involved in the assignment, specifically those with experience in Land Due Diligence. REC reserves the right to suggest alternative team members if necessary. The Title Search Report must be completed either by the successful bidder or their local counsel.

Bidders are required to submit a signed certificate confirming no conflict of interest. Payment for the services will be made in two installments viz. 40 percent after the submission of the final draft of the Title Search Report and 60 percent following the submission of the signed Title Search Report, execution of mortgage documents, and submission of the enforceability opinion.

Additional conditions include no advance payments being made and the bidder bearing all costs associated with preparing and submitting their bid. REC will not be responsible for these costs.

Bidders must also note that REC may amend the bidding documents before the submission deadline and that late bids will be rejected or returned unopened. Furthermore, REC reserves the right to annul the bidding process or reject any or all bids without providing reasons or incurring liability. The key dates for the tender process are crucial for prospective bidders.

The tender will be released on July 31, 2024, marking the official announcement and availability of the tender documents, allowing interested parties to begin their preparations. The last date for submission of bids is August 7, 2024, by 14:00 Hours (IST). This deadline is critical for all bids to be submitted and received by REC. Late submissions beyond this time will not be considered, so adherence to this deadline is essential.

Bidders are advised to ensure their proposals are complete and submitted before the deadline to participate in the evaluation process. The contract will be awarded to the lowest evaluated bid, excluding GST, provided that the bidder meets the qualification criteria. The letter of award will be issued via email to the selected bidder, who must not disclose contract details or documents to third parties without REC’s prior written consent.
