Delhi High Court Issues Permanent Injunction Against Fraudulent Use of Tata Power Solar’s Trademark

Tata Power Solar Systems Ltd. has secured a legal victory as the Delhi High Court issued a permanent injunction against misleading domain names infringing on its trademark, protecting consumers from online fraud.

Tata Power Solar Systems Ltd., India’s fully integrated solar EPC company, and a subsidiary of Tata Power Renewable Energy Ltd., has emerged victorious in a significant legal battle, with the Delhi High Court issuing a permanent injunction to prevent the use of misleading domain names infringing upon its trademark.

The Court ruled that domain names like tatapowersolardealership.co.in, tatapowersolars.com, and others had been unlawfully impersonating the renowned solar brand, deceiving consumers.

Tata Power Solar reported that impostors were utilising these domain names to mislead customers into believing they were authorised representatives of the company. These fraudulent websites were involved in various deceptive practices, including offering non-existent dealership opportunities, fake promotions on solar products, and soliciting payments under false pretences. The Court emphasised the significant risk these actions posed to Tata Power’s customers and the necessity of protecting the company's trademark.

In ruling in favour of Tata Power Solar, Justice Amit Bansal underscored the importance of safeguarding intellectual property, especially considering the company’s widespread brand recognition and annual revenues of INR 1,907 crore.

“This ruling serves as a crucial reminder of the need to defend brand integrity and consumer trust in the digital space. Tata Power Solar’s legal triumph reflects the company’s unwavering commitment to protecting its customers from fraud and maintaining the trust associated with its reputable brand,” asserted the company in a statement.

The Delhi High Court’s judgment marks a pivotal moment in the battle against digital fraud and online impersonation. By taking a firm stand on trademark infringement and deceptive online practices, the Court has reinforced the legal framework that supports companies in their efforts to protect their intellectual property rights. This case sets a strong precedent, reminding businesses of the importance of vigilance in safeguarding their brands and consumers in an increasingly digital world.
